The Arizona law contains many sections. Judge Bolton blocked enforcement of some, and allowed enforcement of others. From Arizona’s perspective, probably the two most critical sections were blocked – sections 2 and 3. This article will discuss some of the existing laws, principles and institutions that frame the issues between the parties. (An evaluation of Judge Bolton’s ruling requires a separate article.)
Some Basic Statutory Law
There are many Federal statutes dealing with immigration, under title 8 of the U.S. Code. For purposes of the lawsuit against Arizona, the following should be noted:
Section 1325 makes illegal entry into the U.S. an offense punishable by fine and/or imprisonment.
